GENERAL SALES TERMS AND CONDITIONS

1- Scope
Our terms and conditions apply to all orders placed on www.aterlier-cosmetic-bio.com. When confirming an order, you (the customer) acknowledge that you have read and agreed our general sales terms and conditions before confirming your order.
ATELIER COSMETIC 23 reserve the right to amend its general sales terms and conditions at any time. In case of changes, terms and conditions valid on the day the order was placed will apply.

2- Products Availability
Our product range and prices as advertised on our website are subject to stock availability. We will check availability on receipt of order. Should the product(s) not be available immediately, we guarantee a delivery within 30 days of your order being confirmed or you will be refunded by cheque or credit voucher. You order’s confirmation date is the date you placed the order if paid by credit/debit card or the date the cheque is cashed if paid by cheque.

3- Orders confirmation and electronic signature (in accordance with the requirements of French legislation on electronic signature, 13th March 2000)
Clicking the " confirm " button at the end of the order process acknowledges that you agree to the order and our terms and conditions in full ; such acknowledgment can only be refuted within the limits stated by our general sales terms and conditions. Clicking the "confirm" button is an electronic signature. Such electronic signature has the same legal validity as a hand written signature.

4-Price
Atelier Cosmetic 23 reserve the right to change its prices at any time. Nonetheless, products will be charged at the price confirmed to you at the time the order was placed, subject to availability.

5-Payment
By cheque : must be in Euros and issued from a French Bank (France only)
Your order will be held for a maximum of 14 days after which, if we haven’t received your cheque, it will be cancelled. Order will only be dispatched after your cheque has been cashed.
By credit/debit card
Payment will either occur on the secure environment of La Banque Postale in direct connection with our online shop or on PayPal secure bank server. If you already have a PayPal account, you can choose to pay from your existing PayPal account. Your order will subsequently be registered and validated as soon as receipt of payment is acknowledged by our partner.

6- Conditions of ownership
All goods remain the property of www.atelier-cosmetic-bio.com until receipt of payment in full by ATELIER COSMETIC 23. However, from the moment our goods leave our premises all risks of loss or damage are transferred to the customer.

7- Intellectual Property
All texts, notes, articles, illustrations and images on this website are the copyright of the author and are protected under intellectual property law. In accordance with the provisions of Intellectual Property legislation, its use is not permitted without prior consent from Atelier Cosmetic 23 and contravenants risk prosecution.

8- Non-Payment
Atelier Cosmetic 23 reserve the right to refuse to accept or deliver an order from a customer who would have failed to pay a previous order in full or partially or with whom a dispute over payment would still be ongoing.

Delivery to France (Excluding DOM/TOM)
Products are delivered to the delivery address given when the order was placed. Admin and Delivery fees are free for orders over € 80 (Incl. Tax) placed on www.atelier-cosmetic-bio.com. For orders under € 80, fees will be charged and depend on weight. Fees will be shown a the end of your order.
Delivery to the rest of the world (Including DOM/TOM)
Standard applicable postal fees will apply.
Delivery Time (to France only and excluding DOM/TOM)
If available, parcels will be dispatched as soon as the order is confirmed and paid for (see article 5). Average delivery time as advised by La Poste (French Post) is 48 hours (for a " Colissimo suivi ").
Delivery Handling
Parcels will personally be delivered to your door by a local post office courier. If you are absent, a card will be left in your letterbox. You must present that card together with an ID to be able to collect your parcel from the post office branch mentioned on the card.
Returns
Returns should be requested within 7 days from the receipt of your delivery. Requests must be addressed in writing (by post or email) to Atelier Cosmetic 23. We are unable to process any request for refund after that period. Products must be in their original packaging. If packaging was opened or damaged during delivery, you must check that products are in good condition and bring this to our attention when returning merchandise.

10- Responsibility
All products offered by our suppliers are subject to the requirements of French Law. Atelier Cosmetic 23 cannot be held responsible for any failure to meet the requirements of the legislation of any other country where products are delivered. Photographs and texts on this website are for illustration purposes only. Consequently, Atelier Cosmetic 23 cannot be held responsible for errors or discrepancies on photographs and texts.
Atelier Cosmetic 23 cannot be held responsible in the event of force majeure, political upheaval, total or partial strike action affecting in particular postal services, transportation and/or communications services, flood and fire.
If you haven’t received part or all of your order, you must let us know within 3 months (from dispatch date). We are unable to address issues brought to our attention after that time.
Despite all its efforts to do so, Atelier Cosmetic 23 cannot guarantee the accuracy of the confirmation posted on its website and therefore cannot be held responsible for any inaccuracies on the information provided. Delivery time, descriptions, photographs and prices may be changed without notice. Photographs are not contractual.

11- Consumer Protection
Customers can return any items within 7 days and request a refund or exchange at no charge to them except return carriage costs (in accordance with article 121-6 of " code de consomation " of French Law).
Please consult us for any requests for cancellation.
Cancellation Fees : carriage cost for cancellations will be paid by the customer.

12- Confidentiality
At any time, you have the right to access, modify or correct any data that relate to you (Art 34 of legislation on IT & freedom, dated 6 Jan 1978). You can address your requests in writing to the above address (by post or email), see our details at the bottom of that page.

13- Governing Law
This agreement shall be construed and performed in accordance with and shall be governed by French Law. Any disputes will be resolved exclusively in the French courts.
